Planning permission?

We are in the process (very early stages) of planning a small extension on the side of our house to add a toilet and utility room. The original house was built around 1910 and there was an extension added in the 70's which increased the floor area by approx 1/3. My question is will we need planning permission? We want to build right out to our boundary and the other side of this is a footpath. I know I'll probably need to contact my local council but they charge £75 just to answer any simple questions!! I hope I've added enough details and thank you in advance

Council websites offer this information and sometimes refer you to a government website that has a simple drawing to guide you

I have looked on the council website but it's so confusing! We've never done anything like this before so it's completely new to us and we don't want to end up wasting money asking questions with obvious answers but equally we don't want to go ahead only to find out we do need permission and be too late!!

I agree with Tani - asking your planning officer is the best way to check what is possible in your particular circumstance. If you have had planning approval then you will have the name of the case officer who dealt with it - that is the best person for you to talk to, as they will already know your project. For your legal situation on the freeholder side then you need to check your title deeds. You should be able to get a copy of these from the land registry if you can't find your own copy. Alternatively speak with your conveyancing solicitors who might have some information stored from your purchase, or be able to advise you.

With conservation land beyond your boundary you may need the local authority to approve your plans, although if your property is outside the CA you should be ok. But you do need to check before you invest in installation. Where I worked (housing association) we had one property in a CA which was a pain, and another opposite the CA boundary, which was easier to deal with, but the local authority always noted the presence of the CA and how our plans might impact it. Better safe than sorry when it comes to CA I’m afraid. Worth a good look at the link provided by Sonia as that may well give some clarity. Also worth chatting to your neighbours as, if I understand it correctly, your decking could be seen as overlooking their gardens? Angie

Do you need planning permission for a garden room? The “permitted development rights” legislation in the UK describes what most homeowners in most parts of the country may develop without having to apply for planning permission. Category E, Outbuildings, covers garden rooms. Whether or not you need planning permission depends on this legislation: in a nutshell, if your property qualifies for permitted development rights, you are allowed to build a garden room provided that it complies with the restrictions described in the legislation for Category E, Outbuildings. If your property does not qualify for permitted development rights, this is usually down to one of two reasons: The property is a listed building, or is situated in a conservation area The permitted development rights have been removed by your planning department as part of a previous planning application (also known as a Clause 4 Exclusion). Planning departments have a scary reputation in some towns. We all know stories, hopefully told to us rather than experienced by us, of planners refusing to grant permission to applications that sound reasonable and straightforward. So far, at Inside Out Oxford, we have not had an application refused. We don’t know for sure, but we like to think that’s because our designs are attractive and sympathetic to the surroundings, and because our project descriptions use wording that helps to sell the intent. Garden rooms used as annexes for a retired parent, for example, help families to stay together affordably and take the load for care off the state. You can pitch that persuasively and appealingly, or miss a trick and not even mention it. And remember, garden rooms are here to stay, post-pandemic. Hybrid working both from home and in the office is much more likely to be the norm for most businesses that can afford that, and nobody likes to set up office in the kitchen, or a child’s bedroom.

Single Storey Extensions & Conservatories

You can build various single storey extensions including conservatories without planning permission, providing the extension accords with the following:

The extension does not sit forward of the principal elevation.
Materials should be similar.
Where it is within 2m of any boundary, the eaves cannot be higher than 3m, and no more than 4m in height otherwise.
Rear extensions — no more than 4m in depth (detached house) or 3m in depth (semi-detached or terrace).
Side extensions — the width of the extension must not be greater than half the width of the original dwelling. Side extensions are not permitted on Article 1(5) Land (e.g. AONB, Conservation Areas).

Also check out the planning portal website and click do I need permission, there are some decent guides there as well. I usually recommend to clients pay the £75 [it's £85 in Sheffield] so you have something in writing from the council and for the avoidance of doubt about what you need to do.

The roof height and obscured glazing to windows will probably be the key things to check here...
