Builder not returning & paid for work

We are refurbishing our house totally, so not living there at the moment.

The builder did a contract originally, but various jobs were added on, which are not in the contract,

He has been paid cash. I held £300 back as I realized he kept asking for the full payment when each job hadn't been completed..

He has held back the boiler remote control & certificate & guarantee. Plus the plumbing hasn't been completed to the 1st fix, just the radiators but nothing else .

I believe I can contact the citizens advice , but I wondered if any one here can give me advice.

I have told him I will contact the Gas council.

Yes, ring up Gas Safe (hopefully he is registered). If he is a registered fitter with the boiler manufacturer you can put in a complaint about him with them too. If he is registered with a website like CheckaTrade you can speak to them too.The next thing might be your local Trading Standards and put in a claim as the Small Claims Court.

Do not make any further cash payments, insist on an invoice and bank transfer.

Only ever use a tradesperson who can provide a written quotes, invoice, and who wishes to be paid by bank transfer in instalments or after completion of the work.

I think you gave to give him the opportunity to finish.
You should write a letter or email that details what you think still needs completing and when you expect him to return and complete it. This should also help you better articulate what is actual work to be done and what work is essentially snagging.
Hopefully he will respond and this will resolve the situation.
If he doesn’t respond at least you have demonstrated communication on your part and have a note of all the outstanding work.

I think when I ran a company contracting to a larger company they kept the retention for 3 months. One did it for 6 months but paid half of it back after 3 months so you could look at doing stage returns of the 5% Ie a month after the build you agree to pay of a portion of the retention and so on. Sometimes the company will add on the retention to their costs though in planning but I would perhaps discuss it with the builder and see what they think. I knew my work was good and wouldn’t fail so I didn’t have a problem with the small retention which gave my customers confidence in my skills.

It sounds like he undertook work he was unfamiliar with and he was unaccredited. Since he failed to deliver his contract and since he has ruined doors that now need replacing you have two courses of action. One option is to instruct your builder to replace the ruined doors and have them fitted by a licensed fire door fitter. When complete and signed off by the fire officer the builder will have met his contractual obligation and you must then pay him what was originally agreed or possibly a higher amount if you think it fair. Alternatively you get the job finished quickly by another professional and pursue the first builder for costs through the small claims court. This would be my preferred route as he falsely claimed he was able to carry out the job, has held up your project and delays will have led to a loss in rental income.

I would go back to the friend who recommended them- I would want them to give me some tips based on their working relationship….. for instance it might be that phoning at 8am is the trick to catching him and getting things done. I would also want the friend to have a word along the lines of - I have recommended you, you are now making me look bad, sort it out. I would also try to better Understand why the builder refers to your house as a nightmare. Is it that there is a complication that is beyond his skill set, is it that he is now letting down future clients because of delays on yours or is it his own stress and unrelated to your house. I think it’s best to understand the issue to know what to do. Then you have to be firm where necessary and pragmatic about other things- so he is not your friend he is an employee and you expect him to turn up to work- but pragmatically you would rather hang on for skilled Labour understanding that although the wait is inconvenient the finish and cost will be better than pressuring him to take on jobs that are not his forte….. I had a situation in a previous house- I missed the booked slot with the tiler, after some pressure from me the builder reluctantly took it on but took lots longer than a tiler would have done, it diverted him from jobs he could do quickly and I paid more because it took a long time plus the finish could have been done better.

He's accepted that we've cancelled (what choice does he have, we've said we can't afford it and I don't think a WhatsApp conversation is enough to say we're in breech of contract). It was just his tone was quite upsetting when I thibk he could have been a little more dignified/professional. We only said that our financial situation has changed so we cant go ahead at this time and we need to reconsider our options later in the year. He's told us not to contact him again as we've messed him about!?

Sorry to hear you’re going through all that, that’s miserable... I’d say nowadays email is better than a letter if you can, purely as you can easily demonstrate you sent it and when.

As a matter of interest did you pay your builder cash for all of the project?
