That's a sapling. Over time the bole will get much thicker and the surface roots will get beyond where the fence is now - but the fence won't last that long. Maturity for this tree is many years away. As the tree will be far prettier than the fence, why sacrifice it anyway? The beautiful mature bark alone will make it worth caring for. Something I can never quite grasp is why it is assumed, whether or not a plant is poisonous, any part of it is ever going to be eaten, even by mistake? For heaven's sake, are we becoming so neurotic we are about to cut and burn everything some half-witted scribbler tells us is poisonous? Even if true (it is but that is beside the point), what are the chances that even a child is going to be tempted to taste it? Earth certainly. Well, my kids tried when very small. Worms, maybe. Slugs or spiders possibly. But even the lowest leaves of any such plant are out of reach. Sleep easy. Leave the tree alone.

What a great picture, and a design that could easily be adjusted for your site, in terms of both hard landscaping and soft landscaping for a Cheshire site. The elements of slabs, wooden boards, rendered walls, low hidden water feature and lush low-maintenance planting can be achieved on a small budget. Water features surprisingly cost quite a bit, even a simple rill such as in the picture with small bubbling jets and lighting. To keep the cost down, you could look for concrete slabs, and use a softer wood and then stain it to the colour you want, rather than going for an expensive Iroko wooden board. Of course, once you start staining you will need a regular care schedule of cleaning it and re-staining it. Perhaps if the budget will allow, you could spend more on say composite decking boards and a stylish piece of furniture, and then use cheaper products elsewhere. A good Internet search will reveal some great products, but don't get carried away. Stick to your idea of how the garden should look and be strict with yourself. Measure your garden and draw up a scaled plan. Indicate what areas will be hard scaping and what will be planted. Note where the sun is during the day and from what direction you have prevailing wind. You can do the research yourself or take your plan to a garden centre where someone on staff will be able to advise you. You can decide in advance what colours you'd like, i.e. soft pastels in pink, blue and violet or hot borders with reds, oranges and yellows. Good luck and enjoy your planning.

Hi Leeza - what well weeded borders you have! And welcome to the world of gardening - its great fun!! The shrubs you have will definitely bush out over time to cover the wall to a greater extent than they do know. I would be tempted to add some summer flowering perennials to fill up some of the space - something very easy to look after like a harder geranium orion or rozanne and maybe some penstemon like Raven - these would bring some colour interest into the area. Also think about some spring bulbs like iris reticulata, crocus or tulips. Good to plant know and they will cheer up the whole area. Other than that get a good mulch/top dressing to try and keep the weeds down!
