Party wall if we remove shared pitch on our side

Hi, I was wondering if I can get advice on if party wall notice is applicable if we to remove the pitch roof that is connected to the neighbours, as to replace it with flat roof to put skylight. Current roof is half pitch connected with neighbors and half flat.

Also do I need an architect to do drawings if we are changing the roof. I had a builder asking for drawings otherwise he can't do the flat roof with skylight, is this correct?

I think you do need a party wall agreement. You will need a building surveyor to do this. An architect would be a good choice unless you are in engineering or the building trade. You might need building control too. Think about when and if you need to sell your house. If you no not have the relevant permissions and sign offs its much harder to retrospectively apply for it. I might have a friendly chat with your neighbour too in advance of this work as it will affect them whilst being completed due to proximity of the roof replacement on your side.

Does your ceiling follow the pitch of the roof?

Installing a Velux would be a far simpler option if you are just looking to get more light in.

I'm no expert but had to look into this when planning an extension as the party wall act also covers other things such as excavating foundations within a certain distance of a neighbour. My understanding is that you can't stop the work taking place but do have the right to decent, in which case the person doing the work has to appoint a surveyor to draw up a party wall agreement. That will cover what is to be done, hours of work, protection put in place, etc and also a survey and photos of your property before and after to check for damage. You can use a shared surveyor or insist on your own independent one. A shared one should be fine unless you have a very good reason otherwise. Will cost your neighbour about £1100. Or you can just agree to it, but given they are cutting right into the party wall and I have read posts (on here I think) where damage has been caused by the same work I would be tempted by the surveyor route with a friendly explanation that you aren't against the work taking place but would like the assurance of a surveyor. You could probably ask the surveyor to ensure that nothing compromises your own ability to convert in future.

Hello, hoping to get some advice/info! We are planning some work on our house and we are attached on one side to our neighbours. We are planning a single story kitchen extension into the garden spanning the whole width of the house. Our neighbours have an extension, however they didn’t build their extension up to/on the property line on our side, it’s about 200mm in from the property line. We’d ideally like to build up to the property line obviously as we want to continue the line of our existing wall - but if we did this, it would leave a small inaccessible gap between our new extension and their existing extension, not good for damp etc. What do we do in this situation? They’ve implied that they want the gap to stay there so that debris can be removed of course, but that would not be our preference for the internal look of our extension. We’d also obviously prefer it if there were no gap at all as they can be problematic. We will of course be doing a party wall agreement etc anyway so I’m sure this will come up, but as it’s our first time renovating I wanted to try and get as clued up as possible in advance! We’re not due to start work until Jan 2021 so we have plenty of time. Thank you in advance!

i like Jethro's idea - and I wouldn't have velux windows in bedroom unless you think it's going to be a really dark room just with the regular windows. definitely add velux in bathroom though. we are extending and keeping the pitched ceilings in bedroom and ensuite, gives a not-huge room a bit more wow factor and less of a box. yes more difficult to position lights and probably to heat too, but worth it i think. ceiling height plays a huge part in how you feel in a room so should always try and maximise wherever possible (within reason, keeping to human scale)

I agree with Paul. You may be able to remove the flat ceiling in the space and open up to the sloped ceiling, install a velum and add insulation and you will achieve what you need without party wall agreements and all the extra cost that entails

Thanks for the responses, yes we need a party wall notice as per the surveyor. Unfortunately, the ceiling doesn't follow the pitch of the roof, it is flat from the inside. The only one reason we wanted to keep it flat all way to the wall is for access to the roof, as it will be a big area pitched making it difficult to access the roof.
