Houzz Shop Terms of Sale

You may be provided the opportunity on the Houzz Platform to purchase products that are sold or manufactured by Houzz Shop International LLC or third parties (collectively “Products”). Such Products are available for purchase from Houzz Shop International LLC (“Houzz Shop”) and all transactions are concluded through the Houzz Platform with Houzz acting for its own account or as an agent for third party sellers (“Seller”) depending on the Products. The “sold by” field on the Product listing indicates whether the Products are supplied by Houzz Shop or by Sellers.

If you participate in the Houzz Shop, you agree to these terms of sale, in addition to the Houzz Terms of Use, which are incorporated herein. The Houzz Terms of Use contain important provisions concerning Disclaimers, Limitation of Liability and Dispute Resolution. Except as modified herein, those provisions apply in full, in addition to the following terms:

  • No Endorsement or Verification. The availability of any Products on the Houzz Platform does not imply our endorsement of the Products. We do not represent, warrant or guarantee that the Product descriptions are accurate, complete, reliable, current, or error-free.

  • Product Reviews. Product listings may contain ratings and reviews obtained from third parties. Product reviews posted by Houzz users are solely the opinions of the posters. None of the Product reviews contain or reflect any opinions or views of Houzz Shop. Ratings given in connection with purchases verified by Houzz Shop may be given greater weight than ratings not verified by Houzz Shop.

  • Order Acceptance and Cancellation Right. The receipt of an order number or an email order confirmation does not constitute acceptance of an order or a confirmation of an offer to sell. We reserve the right to limit the order quantity on any item and/or to refuse service to any customer for any reason. Verification of information may be required prior to the acceptance of an order. Prices and availability of Products on the Houzz Platform are subject to change. Errors will be corrected when discovered, and we reserve the right to revoke any stated offer and to correct any error, inaccuracy, or omission. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Details of your cancellation and return rights can be found in our Return Policy.

  • Buyer Obligations. Without limiting any other provision of these Terms of Sale or the Terms of Use, you are responsible for (a) reading the entire Product listing before placing an order; (b) maintaining correct and up to date payment, contact, and shipping information; and (c) honoring any return, refund or shipping arrangement entered into with Houzz Shop International LLC or any Seller.

  • Products Sold by Houzz Shop on Behalf of Third Parties.

    a. Pricing. Prices for Products sold by Sellers are set by the Seller. See our Pricing Policy for more information about pricing.

    b. Payments. Houzz Shop acts as agent of the Seller for all transactions concluded through the Houzz Platform and receives payment from you on the Seller’s behalf. Once you have paid Houzz Shop you have no further liability to the Seller to pay for the Product. Houzz Shop does not act as your agent with respect to any payments for Products submitted or transactions concluded via the Houzz Platform.

    c. Risk of Loss. For Products supplied by Sellers, the risk of loss and title for purchased Products pass from the Seller to buyer upon delivery.

    d. Returns and Refunds. Products supplied by Sellers are eligible for returns and refunds as indicated in the Houzz Return Policy.

    e. Third-Party Warranty Information. For Products sold by Sellers, warranty information is also listed in the Return Policy. The obligation to satisfy any indicated warranty for such Products is between you and the Seller (and the manufacturer where applicable), and not with Houzz Shop.

  • Products Sold by Houzz Shop.

    a. Pricing. See our Pricing Policy for more information about pricing.

    b. Risk of Loss. For Products purchased from Houzz Shop, the risk of loss and title for purchased Products pass to you upon delivery to the shipping carrier.

    c. Returns, Refunds and Title. Returns of Products sold by Houzz Shop are subject to our Return Policy unless marked as non-returnable. Houzz Shop does not take title to returned items until the item arrives at our fulfillment center. At our discretion, a refund may be issued without requiring a return. In this situation, Houzz Shop does not take title to the refunded item.

    d. Third-Party Warranty Information. See our Return Policy for more information about manufacturer warranties.

  • Customer Service Limitations. While we may help facilitate the resolution of disputes through our customer service team or various programs, Houzz Shop has no control over and does not guarantee the existence, quality, safety or legality of items advertised, the truth or accuracy of Product listings, or that a seller, manufacturer or supplier will satisfactorily honor the warranty offered by that party for a specific Product. Neither Houzz Shop nor any Seller will be responsible for any damage caused by installation or attempted installation of any Product by you or any third-party.

  • Disputes.

    a. For EU domiciled users, we accept liability for death or personal injury caused by our negligence. You have certain legal rights including that our products and services will be of satisfactory quality and as described. Nothing in these Terms of Sale is intended to affect these legal rights or other rights to which you are entitled under applicable law. If we breach these Terms of Sale we shall only be liable for losses which are a reasonably foreseeable consequence of such breach. Losses are foreseeable where they could be contemplated by you and us at the time of entering into these Terms of Sale. We are not responsible for: (i) losses not caused by our breach; (ii) indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us at the time of entering into this Agreement for example loss of profits or loss of opportunity; (iii) product descriptions for and contracts with third parties and their products or services; (iv) failure to provide any services or to meet any of our obligations where such failure is due to events beyond our reasonable control.

    b. If you are domiciled in the EU, you have a right to refer any dispute to the EU's Online Dispute Resolution platform at: https://webgate.ec.europa.eu/odr/main/?event=main.home.show and you also have a right to bring an action in your local courts.
