Party Wall Act advice please!

Hi, we're planning to do a single storey rear extension to our detached property and the surveyor has advised that we may need a party wall act (without actually digging the ground to check the depth of the foundation) given the neighbour's property is within 3m of our planned extension.

Our property was built in 1990 so we think the foundation is more than 1m deep.

1) Am I right in thinking that we won't need to serve the neighbour a notice as long as the extension also follows the same depth (assuming the depth is definitely >1m)?

2) If the building regs officer requires a bigger depth do we then need to get a PW agreement?

3) I find conflicting advice online with some stating the PWA is a joke and that it's not a legal requirement. Ideally I'd like to get away with not serving a notice if it's not necessary.

Our extension falls under permitted development rights which we have already been granted. Do you think we definitely need to serve the neighbour a notice? The surveyor has offered to prepare and serve the neighbour a notice for a fee hence my concern that he's not got our best interest at heart...
