prior approval for a 6m rear extension

The rear of my house is not flush one half of the house extends further into the garden than the other. Can I take my extension 6m from each of the rear walls or is it from the set back wall meaning I am extending by 6m on one side but only 5 m on the other.

Hi Tracey. This maybe worth making a pre-app to the council. If the property was originally built with a projecting element then part of the planned extension would be labelled by the council as a side extension and require a planning permission. Regards Ricky

The loss of light law has many arguable points - this is a bit of it in a nutshell:- The Prescription Act 1832 created two new and distinct prescription regimes: one for rights to light and another for other easements. The rights to light regime provides that where light has been enjoyed across another’s land for 20 years without interruption, and without the written consent or agreement of that landowner,5 a right to light will arise. Unlike lost modern grant or common law prescription claims, under the 1832 Act the 20-years’ enjoyment must be, in the words of the statute, “next before some suit or action”. That means that the 20 years must immediately precede an application to court by the person who claims the right.6 It is not clear whether an application to Land Registry for registration of the right is equally effective as a “suit or action”. As Jo Chrobak says, you may need further investigations and proof, but the solicitor will tell you if that's necessary, or if you can just challenge the Council on their stance. If you can challenge them with one well written letter, then, that will be the cheapest option.

Hi there! I would strongly suggest that you first consider the local regulations. That way you will increase the likelihood of the plan being approved by your council's planning officer (assuming you require permits). Therefore, I would take a look at other similar extensions in your street, see how the shape of the roof would fit in with the existing roof and finally, check if the shape of the roof would make an impact on the neighbouring houses in terms of sunlight. Hi, First, you will need to consider whether or not you will need to apply for planning permission or listed building consent. You can make a planning pre-application enquiry (pre-app) to find out about your specific case, including your local requirements, intended extension shape(s) and the likelihood of approval from your Local Planning Authority. Then you should consider the overall design of the extension, including internal layout, structural support, doors, glazing and natural light. Once planning approval is received (or the design is determined not to need one), you will need to have construction drawings submitted to ‘building control’ to prove that the extension will conform to the building regulations. All of this needs to be completed and approval received before construction begins. Within some limits and restrictions, extensions can be built without full planning applications. In most cases, the current single-storey limit for permitted development is 8m for a detached house or 6m for other houses. Or 3m for multiple storeys and certain distances from your boundaries. If these are exceeded (eg your intention of a 4m first-floor extension) then a planning application would be required, and as Kay said, is unlikely to be approved in a lot of cases.
