Do we need a party wall agreement?

We are planning a single storey extention 3m by 7m ( House width) . We have a detached home with our neighbours homes about 2m away from our own. We have no joining wall but do we need a party wall agreement to carry out the extension

Unless you are trying to join up to them no you don’t.

Thank you I read somewhere that if you are building within 2. 5 m of their property it might be necessary.

Hi, we're planning to do a single storey rear extension to our detached property and the surveyor has advised that we may need a party wall act (without actually digging the ground to check the depth of the foundation) given the neighbour's property is within 3m of our planned extension. Our property was built in 1990 so we think the foundation is more than 1m deep. 1) Am I right in thinking that we won't need to serve the neighbour a notice as long as the extension also follows the same depth (assuming the depth is definitely >1m)? 2) If the building regs officer requires a bigger depth do we then need to get a PW agreement? 3) I find conflicting advice online with some stating the PWA is a joke and that it's not a legal requirement. Ideally I'd like to get away with not serving a notice if it's not necessary. Our extension falls under permitted development rights which we have already been granted. Do you think we definitely need to serve the neighbour a notice? The surveyor has offered to prepare and serve the neighbour a notice for a fee hence my concern that he's not got our best interest at heart... Thanks for comments/ advice.

Hello, hoping to get some advice/info! We are planning some work on our house and we are attached on one side to our neighbours. We are planning a single story kitchen extension into the garden spanning the whole width of the house. Our neighbours have an extension, however they didn’t build their extension up to/on the property line on our side, it’s about 200mm in from the property line. We’d ideally like to build up to the property line obviously as we want to continue the line of our existing wall - but if we did this, it would leave a small inaccessible gap between our new extension and their existing extension, not good for damp etc. What do we do in this situation? They’ve implied that they want the gap to stay there so that debris can be removed of course, but that would not be our preference for the internal look of our extension. We’d also obviously prefer it if there were no gap at all as they can be problematic. We will of course be doing a party wall agreement etc anyway so I’m sure this will come up, but as it’s our first time renovating I wanted to try and get as clued up as possible in advance! We’re not due to start work until Jan 2021 so we have plenty of time. Thank you in advance!

Hi all, I own a top floor flat and will be undertaking works that involve knocking down 3 non-structural walls, replacing flooring and a new kitchen and bathroom. The freeholder has signed off on the works but said I need to check if anything falls under the Party Wall Act. Since Im not actually making any changes to the actual floor to the below flat - I'm only changing the floor from carpet to LVT and remodelling the kitchen - I can't imagine I would need to serve a Party Wall notice to my downstairs neighbour? Similarly for the ensuite the party wall won't be affected, I'll just be changing the tiling and new basin etc. Can anyone advise whether works of this kind would fall under Party Wall Act?

I’d suggest getting a party wall surveyor and offer to pay for this since you get on with your neighbours and your concerns are related to previous work on your property.

2m though should be adequate. Ideally you need to speak to your Planning Dept. It does vary from area to area.

If your new extension foundations are dug within 3 meters of their boundary then you'll need to serve them a Section 6.
