First homeowner (no experience) being taken advantage of with Defects

I'd love to chat to someone that has experience building, to find out if i am well within my rights to seek compensation for what we paid, how bad the end result is, what we can maneuver our life around for them to come and fix, AND what the project manager is telling me they will do to "fix" we feel completely taken advantage of.

I have always bought wrecks - I love renovating: and I completely agree with overpaying for a new renovation that is rubbish and soulless: I won't even view a house that has obviously been done up by one of the many "property developers" that infest London. I can cope with anything (have rectified asbestos, removed wood chip, put back period features and replaced everything from roof to digging up a floor to install underfloor heating in the past), but my absolute nos: dodgy neighbours/road, lack of off-street parking (London), a floor plan I can do nothing with, lack of potential to add value myself. I have seen (and met) some real horrors whilst looking for houses! Also, I have to have a period house: 1930s or older.

Loved reading this discussion! I am an interior designer and have done my interior sketchign courses with BehindCanvas. The tutor is amazing and you can do the tutorials online in your own time and rewatch them. Highly recommend if you're interested in mastering sketching from zero!

TRADESMEN. It's a miracle when one bothers to quote at all ... as such, I now build walls, can plaster, and drive a digger lol... I tile, fit carpets, fitted the kitchen, all with only half of one of my lower spinal discs left. By the time you get a quote back, its more often a month or more down the line and have already hired a couple of lads on a daily rate doing things how you dictate after weeks of research. I hired a roofer to replace my cast iron guttering with aluminium ones, he put up new soffits and fascias BADLY, ran off to assume weigh in my old gutters and ran off with the money for my new ones - steep learning curve there, and a CCJ is no use getting my money back. I purchased a kitchen, it turned up in bad shape, then commenced over 8 months to get to court for my money back... Hired a tree co to remove a load of trees overhanging the house and clear the boundary... an old man cried about a tree that wasnt his anyway so the tree folk abandoned the job. Thankfully I have a great electrician and a reliable plumbing company, but only call them for either gas or. heavier electrical work.... the husband does to electrics and plumbing but he hates it and we do get it checked. I keep trying to find a good builder though. Everything takes so long and its physically and mentally draining on me.... I would MUCH rather have someone I can trust but no luck yet.

Hi JA, We have two dogs and have just moved to a house that requires renovation including structural from top to bottom (and it's 5 bedrooms and 3 floors) We hired Gina from Create Perfect (on here) and she's been absolutely amazing. She prevented us from spending a fortune in unnecessary extensions and showed us how to reconfigure our space through working with a structural engineer to get the space we needed without extending. We were given 3D images of different layouts and floor plans with advantages and disadvantages of each to help us visualise and prioritise what was important to us. She created 3D images of all of our rooms and even shopping lists of the suggested items we should buy. (I've attached a few pics to try and show you what sort of thing you get) She was available 24/7 literally and was more help than I could ever have imagined beforehand. The cost was remarkably reasonable and a fraction of what we're spending on the house. We also benefitted hugely from here trade discounts, which she was happy to pass on. A good designer with me a huge help not only with decorating schemes but the plans and layout for your house, they will also put a high emphasis on what you need and design around it (including pets) so you get a house that fits your lifestyle and doesn't just look like a show room. Best decision I could possibly have made to hire Gina (Create Perfect in here) and can't recommend highly enough the advantages of getting a good designer on board; it made the whole process fun too! Pick the right person and they will be a pleasure to work with and super respectful of your budget and lifestyle. Good luck with your project

I’m a builder in Brisbane.

In QLD there is a document derived for standards and tolerances. See link.

This document is collated from the National Construction Code, Australian Standards, Manufacturers Specifications and so on. Owners and contractors alike can use it as an easy to reference guide for standards etc (including defects).

In QLD, the construction industry governing body that is responsible for contractor licensing and consumer complaints is - The Queensland Building and Construction Commission. In SA you will have your own version of this, a third party who you can turn to if you need advice or are unhappy with work quality.

Whilst the industry standards are a good thing, they can be pretty loose. Meaning if your builder has achieved them but you are unhappy their might not be much you can do.

Excellent. i will do a google, and see what the SA version is. Thank you. it's a great starting point. I see what you're saying re: defects VS standard. but my god they did a terrible job of a BRAND NEW HOUSE. the two townhouses next to us aren't selling because the workmanship is so bad. We stupidly bough off Market and Off plan. So didn't see the end result till we moved in. The PM has come through and agreed to fix majority, but both bathrooms are floor to ceiling tiles, and probably half of the tiles have a black mark on them down the side. But it looks like mould. We obviously want that fixed and in my mind, that means re-tiling both bathrooms. We just aren't prepared to move out of our house and have trades working on both bathrooms... The other part is both downstairs and up, the roof has so many sections where you can see bumps and patching and bad paint. His advice was to repaint and change the lights from regular light to down light (so we wont notice it as much) But thats just sweeping under the rug, something is still wrong. All of these things, im worried will affect the re-sale of our house. There is a huge dent in the metal part of the window seal. He said he can buffer it our, but it wont be perfect. And they wouldn't be able to fix it.. To me, we should be compensated for that. Literally compensated for everything that isn't right, Is that fair? Have you heard of people getting compensated after they bought brand new?

Also, Can i ask for the licences' of all of the people involved in the build?

With respect to compensation - yeah sure. In QLD there is a mandatory insurance fee, Home Warranty Insurance Scheme, that the builder has to pay before the dwelling can receive approval. I’m pretty sure it is the same nationally. The builder pays for it, but it is factored into the overall build/quote, so the homeowner ultimately pays.

Again, defects can be a tricky thing. That’s why the tolerance guide is there. Some people, such as myself, are super particular and see everything. Others are at the opposite end of the scale and just don’t care. And then there is everyone else in between.

So if your unsure, and your builder is refusing on some defects which you think is unreasonable, then it is worth you contacting your state governing body.

I have developed a building guide for homeowners. It’s a bit late for you now since the project is complete, but it may still provide you some guidance. Its available for free download in my website.
