Right of light issue on rear extension

I am planning a rear extension on a mid terrace property but my neighbour has made it know he is not happy because he said it will take his light. He has got a rear extension half way across the back of the property and has put his window and door on the side of the extension which is north facing. I feel my extension would not make much difference to his light. Has anyone else had this problem?

Hi, I am a builder and the bulk of my work is extensions just like the one that you are planning. I my time and some most recently I have built extensions on terraced houses up to the boundaries on both sides and 3m out from the back of the house two stories high, completely blocking the sunlight on to adjoining patios. As long as you get planning permission granted you will have the right to build your extension but before you get it people have the chance to oppose it, and in my experience the "right to light" has never stopped one . Privacy issues with windows looking into adjoining properties is more common, but if you don't have any of these I wouldn't think that you would have any problems. I hope this helps

Right of Light won't prevent planning permission being granted. However, it doesn't prevent your neighbour from suing you after the extension has been built.
Have you checked both your deeds with the Land Registry?
How long has his window been there?
There are lots of different factors involved.

Sorry to say this but I feel part of living in a city is being aware and respectful of neighbours. Good on you for at least consulting them first. We are currently going though a very stressful similar situation but our neighbours are building. They did not give us the courtesy of even telling us and are selling one of the duplexes they are building, which happens to be the biggest and most imposing one & on our side. It is totally taking away our privacy, looking into our kitchen & living area and whole backyard. Plus the only outdoor eating area is only 1mtre from our deck off our kitchen. It is horrible, stressful and we feel we will be forced to sell our lovely home we have been in for 20 years. My advice is move - buy a house which suits your needs as your neighbour will hate you forever and object to everything they can. Not sure where you live but in Australia you have to get an architect/drafts person to draw up overshadowing plans. Please be nice to them, it is stressful and could cause them to become very ill.

I like your plan, I would put an external door on the utility instead. and ideally get the boiler in there if you can. (boiler there more important than door- if its a choice) block up external door to office (not needed) put a cloak room under stairs and use the doorway space - access cloak room from under stairs. Just need to know where your external soil pipe is to confirm. i can recommend an architectural technician. (although you could probably sketch it yourself) he also does B.regs / project management as well, if required re the construction, over hand block build the party wall side. brick and block the rest, you will need a steel over the bifold if wider than 3.6m. cheaper option is to have larger french doors with fixed glazing either side, (then you may not need the steel.) you will need one for the internal partition. so delivering two easy as one i may be able to supply the easi joists and 18mm osb for the roof (bit of a small job) get your services (lights) up in there easily . 5m easy to span try and get a warm roof if poss. (insulation on top and then ur choice of roof covering) check heights when designing and submitting plans) cold roofs are a pain. good luck , happy to help Chris

Hello, It depends on the style of your house I guess but a flat roof is generally a lot cheaper than a gable one. We are lucky in that our ceilings are higher so our flat roof doesn’t make the space feel squashed like some new homes are. It feels airy and bright because we are south facing and have two large rooflights and full glass doors across the back. The rooflights are also flat but get the morning east sun in the kitchen and the other side gets the late West sun. Well they are bright at both times of the day anyway as we are all bungalows in the area so there is nothing blocking the sun! A gable would cost more with the tiles etc but it can also give you height if you lack it (vaulted ceiling perhaps) and catch light from a different angle if you lack it. Try getting a price for your square footage for just the roof tiling vs flat roof coating and see the difference. I think ours (approx 4m x 8m) was around £2,600 ish from memory for the fibreglassing. The beams were easier to fit as well as just lengths so there was less joinery in it.

I think the above comments are all really valid regarding sloping the roof of the extension and joining the existing and new with glazing. This is a really nice way to bring some light into the middle area - adding a window here is also worthwhile if possible if you are end of terrace. The Planners may allow you to have a view out as well as light as long as it is not overlooking. Your current lantern location also doesn't align with either the dining table or island, which may look a little off balance. Also remember to consider the location of any lighting so it doesn't clash with your glazing; pendants and spotlights as these will be what give you ambience and should provide atmosphere and task lighting. We did a similar project recently, extending an existing victorian terrace to house a kitchen/diner. We actually added flat roof lights along the long wall, giving natural light and views over the kitchen workspace and dining area. Check out the Right to Light section of the RICS website, suggest you play it cautiously and get your neighbours agreement before starting any work. You may also need Party Wall Act agreement.
