Does this water feature require planning permission?

Heard a water feature like this in the back garden may require planning permission if its less than 10m from a public road. Is this true?

This water feature is in the back garden and no planning was required. I’m not sure about the 10m rule but would probably make sense if in a front garden and accessible from the street…

Hi Ollie, lovely house congratulations. Do you know when it was built? I'm guessing late 1930's. With regards to your dilemma I'm probably not best placed to give an opinion as I have quite strong views about conservation of buildings. However bearing that in mind I would like to say please don't render it 100%, I think you could potentially devalue the house. Is the current render roughcast? If so this would be typical of the period. Regarding Windows I would be inclined to put in what was original to the house, presumably timber or crittel. Have the original windows already been ripped out, it's hard to tell from the photo? I think if you have a period home which is beautiful the frontage should be maintained, if you want to modernise by using aluminium windows for example apply this to the rear of the house in the form of any future extension you might do. So in summary I would not 100% render, I would repair the existing render if required using the same render type (ie. Not smooth if it is roughcast) and windows should probably be white timber. Sorry if that goes against the modernisation plan but it good to get other opinions! Enjoy your new home and good luck with it all.

Hi everyone, Long time no see, hope all is well. Sorry was busy with work and stuff Just an update, wrt the above topic, I wrote to the Building Regulations, for the Birmingham Council. Which I believe is being handled by Acivicogroup As you know I wish to refurbish the house. Takedown the wall between the dining room and the kitchen (non-weight bearing wall) and insert an RSJ there. Also change the Georgian glass roof of the conservatory, to an all year roof. Besides a complete re-wire, new central heating and a combi-boiler This was the response from Acivicogroup, which is cut and pasted below --You will only need Building Regulations for the roof to ensure the right insulation is used. There is no need for Building Regs for a non-load-bearing wall and you will only need Building regs for the boiler and rewire if a non registered person is undertaking the work. So as long as you have someone who is Gas and Electric registered then just their certificates will cover the work. From a purely commercial point of view, I'd try to shop it to any of the other leaseholders in the block. If they're not all bedsits, there's quite probably interest ... I don't know how you got hold of a property of this kind. But it's a block of flats - and therefore, in all likelihood, leasehold. Which means planning permission alone doesn't buy you anything. You need freeholder approval as well, and that, given you're turning "airspace" into living space, affects the terms of your lease and is quite probably chargeable (the freeholder has to grant a new lease), not just solicitor costs but a downpayment to the freeholder (as a "new flat" is created). You're also likely ending up as (paying) contributor to the building's property management. Then, you need party wall consent; at the very least, the owner of the flat below, but possibly also others aside (because of, say, overshadowing and noise, or structural implications). It can be a maze to navigate this even for a "nornal" extension to a leasehold flat. Don't count on "knowing the other owners" either; it's fascinating to watch what "a little envy" can do. So "commercial" advice, flog it to someone in the building - you'll save yourself so much hassle. "secondary commercial" advice, at least get _all_ the consent paperwork (neighbours, freeholder) in writing before you apply for planning. And "ternary" commercial advice, again before you file the planning application, speak to Kensington's planning advice service, https://www.rbkc.gov.uk/planning-and-building-control/planning-applications/planning-advice-service about the proposal. Given the value of "housing" of any kind in the borough, they may even be inclined, but if you surprise them with a "Daily Mail headline proposal", your idea will be seen a lot less favourable. I suspect you'll have to put a lot of work in to "pull this off" (it is, as other's said, a "snowball in hell" type proposal). Good luck, you'll need it.

Thanks for your reply Mrs P! :) I am trying to avoid the time and cost that planning permission would add. Most people wouldn’t need planning permission for a standard roof window, it would come under permitted development. I would accept paying the planning permission fee of around £250 but the application form is aimed at full extensions and I need to provide as many drawings and as much information as if I were doing an extension, which could cost me around £800/1000 to get done. I was hoping there was a work-around that people in the know might use. My council does offer a pre planning service but that’s also very expensive and needs just as many drawings as pp. You can’t just talk to someone about it as they don’t answer the phone.
